April 28, 2011 Citizenship Documentation Requirements for Licensing
On April 28, 2011, Governor Brewer signed HB 2102 (A.R.S. § 41-1080) into law with an effective date of July 20, 2011. This bill prevents agencies, such as the Securities Division of the Arizona Corporation Commission and the Arizona Department of Insurance, from issuing licenses to applicants residing in Arizona and nonresidents who do not have an equivalent license issued by another state unless they provide specific documentation of citizenship or lawful status. This law also affects existing registered agents in Arizona as they must provide this documentation prior to their 2012 renewal (see your renewal application for further details).
Currently, requirements proving citizenship in order to receive a securities or insurance license are already in place. However, HB 2102 also requires that all presented documents of U.S. citizenship or alien status contain a photograph of the individual, or the individual shall also present a government-issued document that contains the individual’s photograph. Authorized documentation includes:
1. An Arizona driver license issued after 1996 or an Arizona non-operating identification license.
2. A driver license issued by a state that verifies lawful presence in the United States.
3. A birth certificate or delayed birth certificate issued in any state, territory or possession of the United States.
4. United States certificate of birth abroad.
5. A United States passport.
6. A foreign passport with a United States visa.
7. An I-94 form with a photograph.
8. A United States citizenship and immigration services employment authorization document or refugee travel document.
9. A United States certificate of naturalization.
10. A United States certificate of citizenship.
11. A tribal certificate of Indian blood.
12. A tribal or bureau of Indian affairs affidavit of birth.
Even if you apply for your license online, you must mail physical copies of your citizenship documentation to the government agency issuing your license or your application will not be processed.
